Le Fact-Finding Committee (FFC) chargé de se pencher sur la disparition alléguée de drogue dans l’affaire Navind Kistnah a finalement rendu son rapport. Celui-ci a été examiné par le Conseil des ministres ce vendredi 22 février. L’ex-juge Paul Lam Shang Leen a statué qu’aucune drogue n’a disparu et que l’Anti-Drug and Smuggling Unit (ADSU) a suivi les normes établies dans la saisie des 119 kilos d’héroïne, malencontreusement présentés comme totalisant 135 kilos, le mercredi 4 mars 2017.
La différence de poids pourrait s’expliquer par l’utilisation d’une balance manuelle, note le FFC.
Quatre des cylindres saisis par l’ADSU et la Mauritius Revenue Authority (MRA) contenaient 20 colis d’un kilo chacun, tandis que les deux autres n’en recelaient que 19 d’un kilo chacun. C’est ce même nombre qui a été réceptionné par le Forensic Science Laboratory (FSL) pour les analyses d’usage. L’exercice s’était étalé sur six jours en présence des commandos du Groupe d’intervention de la police mauricienne (GIPM) et de l’«exhibit officer» de l’ADSU.
Le «gross weight», emballages compris, était de 123 kg alors que le «net weight», sans emballage, est de 119 kilos.
Le ministre mentor, sir Anerood Jugnauth, avait annoncé au député mauve Aadil Ameer Meea qu’il inviterait un ex-juge de la Cour suprême à enquêter sur cette disparition alléguée. En octobre dernier, les «terms of reference» du FFC avaient été finalisés.
Le communiqué du Conseil des ministres indique que «The main findings of the Report of the Committee are, inter alia:
(a) the provisions of section 58 of the Dangerous Drugs Act 2000 and Part VIII of the Police Standing Orders No. 138 have been scrupulously complied with by the designated Exhibit Officer;
(b) the chain of continuity has been scrupulously recorded at the ADSU Exhibit Room with regard to documents produced, as per the Exhibit Register Book;
(c) the disparity regarding the reading of the weights obtained by ADSU on 09 March 2017 could be accounted for by use of a handheld scale, the accuracy of which was uncertain albeit that the scale was calibrated; and
(d) the Committee is satisfied that having regard to the tight security around the six Exhibits at the time when they were removed from the Freight Terminal to the ADSU Headquarters for sealing and weighing, their removal to the ADSU Exhibit Room for safekeeping, their removal to the FSL and back with tight security, there has been no disappearance of the substance found to be heroin by FSL.»
Paul Lam Shang Leen a recommandé une série de mesures, qui seront adoptées sous la supervision du ministre de la Défense, sir Anerood Jugnauth.
